One Nation One Election

At present, in our country, the elections to the Legislative Assembly of each state and the Lok Sabha of the country are held at different times. One Nation One Election means that Lok Sabha and Assembly elections are held simultaneously across the country. That is, to elect the members of the Lok Sabha and the state legislatures, the voters should vote on the same day, at the same time or in phases.

After independence, the Lok Sabha and Assembly elections were held simultaneously in our country in 1952, 1957, 1962 and 1967, but in 1968 and 1969 many state assemblies were dissolved before the completion of their terms. After that, the Lok Sabha was also dissolved in 1970, due to which the tradition of one country, one election was broken and it was not possible to hold both elections simultaneously.

What are the benefits?

The main advantage of implementing One Country One Election is that it avoids the capital expenditure incurred on elections. At present, as elections to the Lok Sabha and state assemblies are held at different times, crores of rupees are spent on the elections. Conducting both the elections at the same time avoids this unnecessary expenditure. Also, by holding different elections, the code of conduct of elections is often imposed, which puts a brake on the development work in those states.

Implementation process

According to senior Supreme Court advocate Virag Gupta, the Law Commission had issued a public notice in this regard in April 2018, detailing the amendment. According to the Law Commission, the One Nation One Election proposal also impinges on Article 328 of the Constitution, which would require the approval of maximum states.

According to Article 368(2) of the Constitution, approval of at least 50% of the States is required for making such an amendment, but it affects the power and jurisdiction of each State Legislature under the 'One Country, One Election' principle, hence all the State Legislatures in the matter. Approval may be required. After this many other laws including the Representation of People Act will need to be amended.
